BAKER COUNTY BOARD OF COMMISSIONERS
The Baker County Board of Commissioners met for the August 15, 2007 Commission
Session. Present were Commission Chair Fred Warner, Jr., Commissioner Tim L.
Kerns and Commissioner Carl E. Stiff, M.D.
Review/Approval of Minutes: Commissioner Kerns made a motion to approve the
minutes. Commissioner Stiff seconded the motion. Motion carried.
Additions to the Agenda:
The Commissioners discussed the process involved in voting a new Representative
to replace Tom Butler if he leaves before the end of his term.
Scheduled Business:
Professional Services Agreement with Bryan Braun, P.C. The one year agreement
is for services provided as the Jail Medical Provider. Mr. Braun will be paid
on a monthly basis of $850 per month. Commissioner Stiff made a motion to
approve the agreement. Commissioner Kerns seconded the motion. Motion carried.
Local Contract Review Board:
1. An Order Designating A Sole Source Provider for Radio Maintenance Services
for the 911 Consolidated Dispatch Center. Gem State is the only provider in
the area and has been providing repair and maintenance for radios at the 911
Consolidated Dispatch Center. Total compensation for their services may exceed
$5,000 in the 2007-08 fiscal year. Commissioner Stiff moved to approve the
agreement by Order No. 2007-102. Commissioner Kerns seconded the motion.
Motion carried.
2. An Order Designating A Sole Source Provider for Baker County Counsel
Services. Services performed by Mr. Van Thiel will exceed $5000 in the 2007-08
fiscal year. Commissioner Stiff moved to approve the agreement by Order No.
2007-103. Commissioner Kerns seconded the motion. Motion carried.
Citizen Participation:
Kenneth Anderson presented a letter to the Commissioners requesting a list of
RS2477 roads held by the Baker County Road Department.
Scheduled Business
Petition to Vacate Subdivison Roads within J.M. Boyd’s 2nd Addition.
Having no public comment, Commissioner Warner moved to adopt Order No.
2007-312. Commissioner Kerns seconded the motion. Motion carried.
Petition to Vacate Certain Streets Within Homestead by Order No. 2007-311.
Having no public comment, Commissioner Kerns made a motion to vacate certain
streets within Homestead by Order No. 2007-311. Commissioner Stiff seconded
the motion. Motion carried.
Ratification of Documents:
1. Modification No. 003 to the Participating Agreement between Baker County and
Wallowa-Whitman National Forest. Commissioner Kerns made a motion to ratify
the agreement. Commissioner Stiff seconded the motion. Motion carried.
2. Memorandum of Understanding between Baker County and Baker Enterprise Growth
initiative (BEGIN). Commissioner Kerns made a motion to ratify the agreement.
Commissioner Stiff seconded the motion. Motion carried.
Documents to be Signed:
1. Order No. 2007-313 Designating the Baker County Sheriff as the Corrections
Supervisory Authority. Commissioner Stiff moved to approve Order No.
2007-313. Commissioner Kerns seconded the motion. Motion carried.
2. Title II Project Submission Form. Commissioner Warner has ranked the
Whitman Ranger District Whitetop Noxious Weed Project first for Title II
funds. The West Fork Burnt River Stream Restoration Project was ranked second,
and the West Fork Burnt River Watershed Restoration/Juniper Removal was ranked
third. Commissioner Kerns moved to approve the designations as listed by
Commissioner Warner. Commissioner Stiff seconded the motion. Motion
carried.
Measure 37 Claim:
M37-06-083: Lonny Hytrek, listed as secretary of Francis Pascoe-Tullis Reunion,
Inc.
Location: Tax Lot 100 in Section 8 of Township 10S, Range 37E. 10.00+/- acres
Tax Lot 200 in Section 8 of Township 10S, Range 37E 10.00 +/- acres
The claim is being continued from the prior Commission Session that took place
on August 1, 2007. Ms. Holly Kerns gave a brief summary of what took place at
the prior Commission Session. The property was deeded into a corporation after
it had been administratively dissolved by the State of Oregon. Therefore, the
deed was considered null. Ms. Kerns notified the Commissioners that Baker
County Counselor Dan Van Thiel concurred with their findings. The Planning
department is recommending that Baker County does not recognize the deed as a
corporation and to approve the claim based on the dates of ownership. The
ownership dates would then be October 8, 1993 and September 16, 1996. Ms.
Kerns also notified the Commissioners of a letter received concerning the
potential fire hazard and the accessibility of fire equipment to the
property. Commissioner Warner reported that if the claim is approved, the
applicants would still need to work through any land use restrictions.
Commissioner Warner then asked for any further comments, in which Mr. Martin
Leuenberger had no comments to add. Mrs. Susanne Moses asked what the County’s
liability would be if the roads leading into the area does not meet the fire
safety standards. Commissioner Warner replied that the County wouldn’t have
any liability, but the roads would need to meet the TSP plan. Commissioner
Kerns made a motion to approve Order No. 2007-309. Commissioner Stiff seconded
the motion. Motion carried.
Mountain Valley Mental Health 2007-2008 Agreement:
Commissioner Warner began by listing the changes made to the most recent draft
of the Mountain Valley Mental Health, 2007-08 Agreement. Mr. Gary Dielman
wondered who would prepare the implementation plan. Susanne Moses notified the
Commissioners that the local mental health authority (County) is responsible
for the plan. Mrs. Moses then proceeded in reading the ordinance regarding the
implementation plan. Commissioner Warner agreed that the Commissioners would
need to sign off on the plan and the State would then approve it. The new plan
will be due in 2008.
The matter of the assets at dissolution was also discussed. The current draft
of the contract lists Mountain Valley Mental Health, Inc as the recipient of
the assets upon dissolution. However, the Commissioners will have County
Counsel Dan Van Thiel review the matter. Commissioner Warner reported that the
County Counsel has been out of town and hopes to have the agreement ready by
the September 5, 2007 Commission Session.
