COUNTY COMMISSIONER TIM L. KERNS COUNTY COMMISSIONER DR. CARL STIFF The Baker County Board of Commissioners met for the December 3, 2008 Commission
Session. Present were Commission Chair Fred Warner, Jr., Commissioner Carl
Stiff, and Commissioner Tim L. Kerns.
2. Citizen’s Participation:
· Mr. Steve Culley commented on the road zoning meeting that occurred December
2, 2008 at the Extension office.
· Mr. Andrew Bryan gave a brief update on Baker City. He also updated the
Commissioners on the Halfway City Council and Transient Room Tax.
3. Review/Approval of Minutes:
Commissioner Kerns made a motion to approve the November 26, 2008 Commission
Session minutes as presented. Commissioner Stiff seconded the motion. Motion
carried.
4. Additions to the Agenda:

Documents to be Signed:
1. Order No. 2008-182 Appointing Gary Marlette as Justice of the Peace Pro-Tem
for the Baker District. Commissioner Kerns made a motion to approve Order No.
2008-182. Commissioner Stiff seconded the motion. Motion carried. Mr. Gary
Marlette was present to be sworn in by Commissioner Warner.
2. Order No. 2008-188 Appointing members to the Local Public Safety
Coordinating Council (LPSCC). The following members will be appointed to LPSCC
for a term set to expire November 1, 2010: Wyn Lohner, Mitch Southwick, Matt
Shirtcliff Greg Baxter, Will Benson, Fred Warner, Jr., and/or Dr. Carl Stiff,
Staci Erickson, Debbie Hoopes, Vicki Long, Sam Bass, Sandy Wood, Gary Dielman,
Bart Murray , Judy Gilmore, Jerry Boyd, Dave MacManiman, and Judy Barzee.
Commissioner Stiff made a motion to approve Order No. 2008-188. Commissioner
Kerns seconded the motion. Motion carried.
5. Scheduled Business
a. Department Update: Watermaster
Mr. Rick Lusk was present to give an update. Oregon Water Law will be
celebrating their 100th anniversary next year. They are expecting Tom Rudolph
to retire in the near future. Baker County has a total of 3,500 water rights.
The State of Oregon has 85,000 water rights for surface water. Mr. Lusk
reviewed the rules of water rights in Baker County. There are three agencies
that can apply for in-stream water rights: ODFW, Parks, and DEQ. They have
established two phases of water diversion. Phase I states that points of
diversion that have a permit condition must have a water measuring device in
place before water can be used. Phase II is in coordination with ODFW. They
have identified areas that they felt were important for water control and for
fishery benefits. Eagle Creek Basin has been identified as one of those
areas. They are working with the landowners in that area trying to establish
control by using water measuring devices. Mr. Ivan Gall reported on some of
the groundwater issues within the County.

3. BCLA Union Contract: Sheriff Southwick was present to discuss the contract.
The contract includes Consolidated Dispatch, Parole and Probation, and the
Sheriff’s office. Salaries will increase by 4% every year for three years.
There will be incentive pay for DPSST certification consisting of 2% for
intermediate and 4% for advanced. Health insurance remained the same. If
insurance costs rise, the employee will pay 5% of the costs. Commissioner
Kerns made a motion to approve the Baker County Law Enforcement Agreement.
Commissioner Stiff seconded the motion. Motion carried.
4. Donation Permanent Easement File #7393 004. The document grants a permanent
easement to the City of Baker City for the purpose of constructing and
maintaining slopes. Relocate, construct and maintain utility lines for the “D”
street project. The property described as 09S-40E-16BB Tax Lot 3800 is 517
square feet more or less. The County also grants a temporary easement for a
work area for construction purposes over and across the land consisting of 669
square feet more or less. Commissioner Warner made a motion to approve File
#7393 004 for the donation of a permanent easement and temporary easement for a
work area. Commissioner Stiff seconded the motion. Motion carried.
Scheduled Business
a. DVD: Introduction to Coordination. The DVD presentation by Fred Kelly
Grant of Stewards of the Range emphasizes the importance of coordinating with
agencies who are implementing policies that affect residents and the role that
county commissioners play. Commissioner Warner recently attended a conference
where Mr. Grant discussed the differences of “coordinating” and “cooperating”
with agencies. Mr. Grant will be visiting Baker County at some point in
January to meet with the Commissioners. Commissioner Warner would like to put
a natural resource advisory committee into action to address “coordinating”
issues.
b. Public Hearing: RLF Homestead Properties Zone Change Request
Commissioner Warner opened the public hearing for the purpose of obtaining any
new testimony on the proposed zone change.
Mr. Andrew Bryan, Marketing Director of BCDC voiced his support of the project
stating the benefits to the economy and transient room tax revenue. The
project could also provide potential visitors to a proposed trail network that
is in the preliminary stages of development.
Having no further testimony Commissioner Warner closed the public hearing and
moved to deliberations.
The Commissioners reviewed the amended staff report presented by Mr. Bennett
and concurred with all of the criteria, findings of fact and conclusions.
Commissioner Stiff made a motion to approve the plan amendment request,
PA-07-005 to amend the Baker County Comprehensive Plan map and the Baker County
Zoning and Subdivision Ordinance map to change the existing zone of Exclusive
Farm Use (EFU) of the property discussed to the Homestead Recreation Limited
Use Combining Zone. Commissioner Kerns seconded the motion. Motion
carried.
Order No. 2008-189 Amending the Baker County Comprehensive Land Use Plan and
the Baker County Zoning map to change two parcels zoned EFU to the Homestead
Recreation Limited Use Combining Zone. Commissioner Kerns made a motion to
approve Order No. 2008-189. Commissioner Stiff seconded the motion. Motion
carried.
Mr. Bennett stated there will be a twenty-one day appeal period to the Land Use
Board of Appeals. If there is no appeal within this time period, then the
decision is final.
6. Documents to be Ratified
a. Amendments #28 and #29 to the 2007-2009 Intergovernmental Agreement for the
Financing of Mental Health, Developmental Disability and Addiction Services
Agreement #119921. Commissioner Kerns made a motion to approve amendments #28
and #29. Commissioner Stiff seconded the motion. Motion carried.
Additions to the Agenda:
¨ Transmission Line: Commissioner Warner along with staff from Idaho Power
attended a meeting in Durkee recently to discuss the proposed routes of the
transmission line. Commissioner Warner would like to protect the landowners
from any possible price gouging and keep all information out in the open. The
County would be compensated for any costs associated with this project. The
County will begin working with Idaho Power to identify a route for the
Transmission Line. Once a route is selected, an environmental impact study
will be done for that area.
¨ AOC Convention: Commissioner Warner and Commissioner Stiff discussed the AOC
Convention that they recently attended.
