BAKER COUNTY BOARD OF COMMISSIONERS
The Baker County Board of Commissioners met for the November 4, 2009 Commission
Session. Present were Commission Chair Fred Warner, Jr., Commissioner Carl E.
Stiff and Commissioner Tim L. Kerns.
2. Citizen’s Participation:

3. Review/Approval of Minutes:
Commissioner Kerns made a motion to approve the October 21, 2009 Commission
Session minutes as presented. Commissioner Warner seconded the motion. Motion
carried.
4. Additions to the Agenda:
a. Justice Court Copy Machine Bid Approval (see contract review board below)
b. Resolution No. 2009-1045: Authorizing an Interfund Loan from the General
Fund to Fair Board Fund (see 5.c. below).
c. Resolution 2009-1046: Authorizing an Interfund Loan from the Facilities
Maintenance Fund to the County General Fund. Ms. Cook reported that they have
been expending funds faster than the tax monies have been coming in.
Commissioner Kerns made a motion to approve Resolution No. 2009-1046.
Commissioner Stiff seconded the motion. Motion carried.
d. Order No. 2009-180 Appointing Richard Langrell to the Transient Lodging Tax
Marketing Committee for a term set to expire November 4, 2010. Commissioner
Kerns made a motion to approve Order No. 2009-180. Commissioner Stiff seconded
the motion. Motion carried.
e. Order No. 2009-181: Approving a petition for the formation of the Pine
Eagle Health District. A public hearing was held in Halfway on November 2,
2009 to take testimony to determine if the area could be benefited by the
formation of the district and to consider boundary changes. A final hearing
will be held on December 7, 2009 at 6:00 p.m. at the Pine Eagle High School
Library to take further testimony on the proposed district formation.
Commissioner Warner made a motion to approve Order No. 2009-181. Commissioner
Stiff seconded the motion. Motion carried.
5. Scheduled Business:
a. Department Update: Weed Department ~ Arnie Grammon
The Weed Department has been successful in using biocontrol to aide in the
eradication of certain types of weeds. A case in point has been the use of
Mecinus Janthinus, a stem-boring weevil, that is in it’s second year in an area
near Sumpter. They hope to use whitetop biocontrol in the near future in areas
that are steep and hard to reach on foot. The bugs used for biocontrol are run
through the Oregon Department of Agriculture, who can release them in areas
requested by the Weed Department. They continue to have a successful herbicide
giveaway, which provides landowners with 5 gallons of herbicide at no cost. In
addition to the herbicide giveaway, the Weed Department is currently offering a
50 pound sack of grass seed to landowners with a proven record of weed
control. Mr. Grammon reported on an experimental test plot near Keating where
they are trying out a new granular type of herbicide on Medusahead. So far it
has been very effective and they hope to conduct an aerial application as
needed.
b. Healthy Start Job Reclassification ~ Debbie Hoopes
Ms. Hoopes is requesting the Family Support Worker for Healthy Start be
reclassed from a range 13 to a range 11 due to changes in how the Healthy Start
program is administered. The Family Support Worker is one who visits parents
of first birth newborns to provide support and information. Commissioner Kerns
made a motion to reclassify the Family Support Worker position for Healthy
Start from a range 13 to a range 11. Commissioner Stiff seconded the motion.
Motion carried. Ms. Hoopes gave a brief update on H1N1 vaccine stating that
the vaccine is slowly trickling in. They currently have 600 people on a
waiting list and they are trying to prioritize them based on a state mandate
with 6 month to 24 year-olds along with pregnant women having priority. Their
plan is to provide the health care providers with 50 doses each and then
provide a clinic as more vaccine becomes available. They are encouraging the
public to call in and get on the list.
c. Fair Board Funding Request ~ Colleen Taylor ~ Resolution No. 2009-1045:
Authorizing an interfund loan from the general fund to the Fair Board Fund.
Ms. Taylor was present to request a loan of $25,000 in order to pay for the
completion of Phase II of the Events Center. They have applied for grant funds
to help pay for portions of the project, but have not been approved yet. They
hope to be moved into their new offices by November 16th. Commissioner Kerns
made a motion to approve Resolution No. 2009-1045. Commissioner Stiff seconded
the motion. Motion carried.
d. Contract Review Board
1. IGA with Grant County for snow removal along Baker County Road #520 aka
Granite Hill Road. The contract shall not exceed $25,000 and is set to expire
March 31, 2014. Mr. Helgerson reported that Grant County normally contracts
with a private party to remove the snow. Commissioner Stiff made a motion to
adopt the Intergovernmental Agreement with Grant County for snow removal along
Baker County Road #520. Commissioner Kerns seconded the motion. Motion
carried.
2. Justice Court Copier Replacement Bids. Bids were received from Ikon, Tec
Copier and Xerox for the purchase of a copier to replace the current copier in
Justice Court. Mr. Bill Lee, Technology Director, is requesting approval of
the bid submitted by Ikon for a Ricoh MP2550 copier with the scan/print option
for a total price of $3,577.60. The Ikon bid is not the lowest bid received,
however Mr. Lee stated that several other departments have had better success
with Ricoh with fewer breakdowns and quick easy service. It’s a free-standing
copier, which will be able to accommodate the higher volume of work. All
maintenance, toner and cleaning are included with the purchase. Commissioner
Kerns made a motion to accept the bid submitted by Ikon for the purchase of a
Ricoh MP2550 copier for a price of $3,577.60. Commissioner Stiff seconded the
motion. Motion carried.
e. Public Hearing: Ordinance No. 2009-01 Allowing low-speed vehicles to operate
on designated Baker County roads.
Commissioner Warner opened the public hearing to take testimony on Ordinance
No. 2009-01 that would allow low-speed vehicles to operate on designated Baker
County roads. The ordinance addresses vehicles with top speeds of 25mph that
operate on roads with speeds of 35mph or higher. The road in question is Baker
County Road #709 commonly known as the West Campbell Loop Road. County
Roadmaster, Ken Helgerson stated that he would like to keep the roads limited
to a case-by-case study. The Sheriff was also consulted and saw no safety
issues associated with the proposed ordinance. A second and final hearing will
be held on December 2, 2009. Having no further testimony, the hearing was
closed.
f. Disabled American Vets Fund Request ~ Carl Swinyer
Mr. Swinyer reported a shortage of $2,230.33 for the DAV van. With the help of
six drivers, the van transports veterans to doctor appointments in Boise, Id.
They average 16 veterans over the course of three or four trips a week. They
would like to use the funds to purchase a new van that currently has over
152,000 miles. Commissioner Kerns made a motion to approve funding of $2,000
to the Disabled American Vets. Commissioner Stiff seconded the motion. Motion
carried.
g. Sanitary Inspection Contract Discussion ~ Annie Bood
Ms. Bood was present to request the Board to consider hiring her to conduct the
sanitary inspections for Baker County. Ms. Bood is a licensed Environmental
Health Specialist with a degree in food and nutrition and would be willing to
work part-time as a contractor. Baker County currently contracts with Malheur
County to conduct the inspections of motels, RV parks, restaurants, child care
providers and public pools. Ms. Bood would provide semi-annual inspections
with 100% guarantee of completion. Ms. Bood is also willing to provide Baker
County with 10% income from total fees collected. If Baker County were to
contract with Ms. Bood they would need to provide Malheur County with a six
month written notice. The Commissioners agreed to take Ms. Bood’s offer under
consideration and further review prior to making a decision.
6. Documents to be signed:
a. Order No. 2009-175: Appointing members to the Baker County Phillips Lake
Fishery Improvement Committee. Members of the committee include Frank Bishop,
Blanie George, Carl Kostol, Dr. Carl Stiff, Randy Joseph and Moe Linzel. The
term is set to expire November 1, 2010. Commissioner Kerns made a motion to
approve Order No. 2009-175 appointing the members listed above to the Baker
County Phillips Lake Fishery Improvement Committee. Commissioner Warner
seconded the motion. Motion carried.
b. Order No. 2009-176, 2009-177 and 2009-178: Appointing Dan Weitz, Jim Young
and Jerry Franke, respectively, to the Powder Basin Watershed Council for a
term that will expire November 1, 2012. Commissioner Kerns made a motion to
approve Order No. 2009-176, 177, 178. Commissioner Stiff seconded the motion.
Motion carried.
c. Order No. 2009-179 and Order No. 2009-182 Appointing Linda Tester and
Dustine Clayborn, respectively, to the Mental Health and Developmentally
Disabled Advisory Committee for a term that will expire November 1, 2013.
Commissioner Stiff made a motion to approve Order No. 2009-179 and Order No.
2009-182. Commissioner Kerns seconded the motion. Motion carried.
d. City of Greenhorn Trustee Property Sale: The property consists of four
lots located within the city limits of Greenhorn. The minimum bidding price
has been set at $6,350.00. Greenhorn Property Trustee, Larry Pearson, will
conduct the sale of the property. Commissioner Warner made a motion to approve
the real estate transaction within the City of Greenhorn. Commissioners Stiff
seconded the motion. Motion carried.
7. Ratification of Documents:
a. Baker County Fair Change Order No. 3 for Wilson Cabinet & Supply and
Change Order No. 2 for Ne-Hi Enterprises. Commissioner Kerns made a motion to
ratify Change Order No. 3 for Wilson Cabinet and Supply and Change Order No. 2
for Ne-Hi Enterprises. Commissioner Stiff seconded the motion. Motion
carried.
